Who Qualifies?

Individual taxpayers who accept that they will pay back the taxes they own through an installment agreement can qualify for the IRS Fresh Start Program if they:

  • Owe less than $50,000 or can pay a larger liability down to that amount

  • Can pay off the remaining debt in 60 months or less

  • Haven’t previously fallen behind on tax payments

  • Have up-to-date tax filings through the current year

  • Maintain the installment agreement and don’t incur new tax debt

  • File for an OIC and can pay the agreed settlement off within 12 months

What Are My Repayment Options?

When you qualify and agree to the IRS Fresh Start Program, there are two payment options. The first is the extended installment agreement, which reduces fees and penalties for tax bills while requiring you to pay off your debt in full. You can have either a short-term plan or a long-term installment plan, and they each work differently. Kedra A Flowers can help you understand your options and find a plan that works for you.

The second repayment option is called offer in compromise and it is for taxpayers who have demonstrated that they cannot pay their bill in full. Essentially, you will need to prove that paying the full amount of the taxes that you own will create an insurmountable financial hardship. If you are in this situation, the IRS may forgive a portion of the amount owed and you will create a repayment plan for the remaining amount.
